The Divorce Process

Although I have set out the general Divorce Procedure in the above Video it is important that you take Legal Advice to ensure that your case proceeds smoothly.

Each case depends upon its own unique facts and there are pitfalls if you do not have the correct advice.  For example, as the Petitioner (the person requesting the divorce) you need to:

  • Ensure that you make all your financial claims
  • Ensure that you make a claim for costs
  • Ensure that the Statement of Case has the correct information

as the Respondent you need to:

  • Complete the Acknowledgement of Service Form correctly to protect you in any future proceedings
  • Complete the Acknowledgement of Service Form correctly to protect your position in respect of costs

Without the correct advice you may be left in the position of not being able to claim the costs and you may find that the matters raised in the Petition, if you are the Respondent are used against you in other proceedings for example, Financial Remedy Proceedings or Proceedings relating to children.

Timing is also important when following the Divorce Procedure, especially if it is alongside Financial Remedy Proceedings, for example, you need to ensure that you can make a Pension claim, which is often the largest matrimonial asset.

Financial Settlements & Divorce

Each case depends upon its own unique facts and there are pitfalls if you do not have the correct advice for example, as the Applicant (the person requesting the financial settlement) and the respondent (the person responding to the application) you need to:

  • Ensure that you make all the Financial Claims that you are entitled to make so that you achieve a fair final settlement
  • Ensure that there is full and frank disclosure of each parties’ finances, including details of income, capital and pensions to achieve the best outcome for you
  • Ensure that correct valuations are carried out, which may be in respect of property or businesses again to achieve the best outcome for you
  • Ensure that one party is not disposing of assets to defeat your claims.

Without the correct advice you may be left in the position of not having pursued all of the financial claims which you are entitled to make, or your former spouse may be disposing of assets to defeat your claims.
