Although I have set out the general Financial Remedy Procedure in the above Video it is important that you take Legal Advice to ensure that your case proceeds smoothly.

Each case depends upon its own unique facts and there are pitfalls if you do not have the correct advice for example, as the Applicant (the person requesting the financial settlement) and the respondent (the person responding to the application) you need to:

• Ensure that you make all the Financial Claims that you are entitled to make so that you achieve a fair final settlement
• Ensure that there is full and frank disclosure of each parties’ finances, including details of income, capital and pensions to achieve the best outcome for you
• Ensure that correct valuations are carried out, which may be in respect of property or businesses again to achieve the best outcome for you
• Ensure that one party is not disposing of assets to defeat your claims.

Without the correct advice you may be left in the position of not having pursued all of the financial claims which you are entitled to make, or your former spouse may be disposing of assets to defeat your claims.
