What questions to ask a solicitor when starting Divorce Proceedings

Embarking on a divorce is a critical step that requires the right guidance.

Here are the key questions you should ask a solicitor, and how Avenue Solicitors, with their proven expertise, can assist you:

Can you outline the legal process and timeline for a Divorce?

Yes, we provide a detailed roadmap of the Divorce process, helping you prepare for what lies ahead. Each step is explained to you and you will receive a confirmatory email at each stage, keeping you fully informed and appraised of the proceedings.

What are my financial entitlements and obligations?

Our team works meticulously to assess and advocate for your financial interests. You will appreciate that every case is different; we take the time to fully understand your financial position so that we can assess your financial entitlements and obligations, giving you direction and guidance to reach a settlement.

How will our assets and debts be divided?

We ensure a fair allocation of assets and debts, tailored to your unique situation, applying the Law. We are able to assess whether your case is what is commonly known as a “needs case “ which generally means that the Matrimonial Assets are limited and the needs of the parties, including the needs of any minor children need to prioritised or whether your particular case is a “Sharing case” where the assets are sufficient to meet each parties’ individual needs, including those of any minor children.

Once this is established we work with you to try to reach an agreement without having to engage in Court proceedings, which are costly, lengthy and mentally exhausting.

What child arrangements can be made for support and contact?

Our family law experts help you to negotiate arrangements that prioritise your children’s welfare and ensure ongoing parental relationships remain child focused.

Each family is unique and arrangements need to be made that are in the best interests of your children.

What are the potential legal costs?

We offer an initial review call at no cost, which enables us to assess how we are able to assist you. Thereafter, we arrange a consultation which is for an hour and during which we take detailed information from you and provide you with options as to the way forward; at that stage, we are able to provide a costs estimate to move your matter forward. Avenue Solicitors are very transparent and we will keep you appraised of the costs as we move your case forward.

What should I expect during mediation sessions, if necessary?

Avenue Solicitors can direct you to skilled mediators who will guide you through every session, fostering a constructive dialogue. We suggest that we advise you alongside the Mediation process to assist with reaching an amicable agreement.

Are there any alternative dispute resolutions to consider?

As members of Resolution, we adhere to their codes of conduct, and explore all viable options, aiming for the most amicable solutions. There has been a recent change to the rules before Court proceedings can be issued, in that all non-court dispute resolution, needs to be explored prior to any proceedings being issued. By way of example, Mediation, Arbitration, and Collaborative Law are some of the options which should be explored and engaged in.
Non-court dispute resolution is the least contentious, most cost-effective way to reach final agreements.

How do you ensure confidentiality and sensitivity in handling my case?
