The new Law and Procedure will replace the old system of having to give a reason for the irretrievable breakdown of the marriage.
No-fault divorce will reduce conflict, allowing couples to focus on important issues like children, property and finances.
The procedure and language used to obtain a divorce has been simplified. Further an application for a divorce can be made by one party alone or jointly by both parties and it will no longer be possible to contest a divorce.
Under the new Law, all that needs to be set out in the application for divorce is a statement that the marriage has broken down irretrievably. The necessity to blame the other party for the breakdown of the marriage has now been removed.
The aim of the new legislation is to take the acrimony out of divorce proceedings and to modernise the approach, recognising that marriages do fail and that it is unnecessary to blame the other party when this happens.
