Injunctions
Under the Family Law Act, an injunction can be granted to individuals in family law disputes, particularly in situations involving domestic violence, harassment, or child arrangement issues. Its primary aim is to safeguard individuals, especially vulnerable parties from harm or harassment.
They play a crucial role in providing protection and addressing urgent concerns in family law matters, ensuring the safety and well-being of affected individuals.
There are two types of injunctions used in family law to provide protection, but they serve different purposes:
- Non molestation Order – An NMO is designed to protect an individual from harassment, violence or threats. It prohibits the other party from engaging in specific behaviours that cause harm or distress to the party seeking the injunction.
- It can prohibit the other party from contact or commuting with the party seeking the injunction and/or approaching or coming within a certain distance of the party or their home.
- Occupation Order – An occupation order regulates who can live in the property associated to the parties. It can grant or restrict access to the home to protect the individual from harm.
- The order may grant one party the right to occupy the family home whilst excluding the other party or require one party to leave the property and refrain them from entering it again.
