What Is Probate?

Probate is the process that needs to take place when someone dies to administer their estate.

If your loved one dies and leaves a Will, this provides the instructions on whom they have appointed as executor. This can be one or more individuals or even a solicitor, but whoever the executor is has the legal responsibility to prepare the estate and divide it as the Will instructs. In addition, the executor has to apply for a Grant of Probate from the court. This allows them to legally distribute the estate and complete all of the necessary paperwork and administration connected with probate.

If your loved one has not left a Will, the process is different. The law of intestacy (dying without a Will) dictates who can act on behalf of the person who died, and this is usually next of kin. You will have to apply to the court to get Letters of Administration, which will allow completion of administration of the estate.

You may decide that you do not want the responsibility of being an executor at all. In these circumstances, we can take the matter off your hands and complete the probate process as quickly and efficiently as possible on your behalf.

Information regarding the likely costs involved in your case

For probate work in relation to uncontested cases where all the assets are in the UK, to include both testate and intestate, taxable and non-taxable estates we charge on an hourly rate for advice and work carried out. Sadhana Joshi’s hourly rate is currently £250 per hour plus vat (currently 20% of chargeable fees) and standard letters (by post or email) and telephone calls are charged at 1/10th of the hourly rate, at £25 each plus vat. 

The complexity of the case and assets involved determines the fees which will ultimately be charged, as this will determine how much time will be spent, for example, if there is a valid will, one beneficiary and no property, costs will be at the lower end of the range. If there are multiple beneficiaries, multiple properties and bank accounts, disputes between beneficiaries, claims against the estate and inheritance tax payable then costs will be at the higher end.

Information regarding the length of time your case will take

On average, the administration of an estate takes between 6 months and three years and costs between £2,000 and £15,000 plus vat and disbursements. Typically, obtaining the grant of probate takes one to six months. Collecting assets then follows, which can take between four weeks and nine months depending upon number, information and location. Once this has been done, we can distribute the assets, which normally takes between four weeks and six months.
